Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) are a legal agreement between you (“you” or “User”) and DIGISMART MEGA LTD, a company registered in England and Wales (Company Registration Number 16925464), whose registered address is 192 Downing Road, Dagenham, England, RM9 6LU (“we”, “us”, or “SmartCodeFixer”).

By creating an account, subscribing to any plan, or otherwise using the SmartCodeFixer service at smartcodefixer.com, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service. If you are using SmartCodeFixer on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

SmartCodeFixer is a subscription-based, AI-powered code debugging platform. The service analyses code you submit, identifies bugs and errors, provides context-aware explanations, and suggests corrections. Features vary by subscription plan. We reserve the right to modify, expand, or discontinue features at any time, and will give reasonable notice of material changes where possible.

3. Subscription, Billing, and Pricing

SmartCodeFixer is sold on a monthly subscription basis. Your subscription begins on the date you complete your first payment and renews automatically on the same calendar date each month until cancelled. Payment is processed by Stripe, Inc. on our behalf. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

We will give you at least 30 days' written notice by email before any price increase takes effect. Continued use of the service after the effective date of a price change constitutes acceptance of the new price. If you do not accept the new price, you may cancel your subscription before the change takes effect.

4. Cancellation

You may cancel your subscription at any time by emailing info@smartcodefixer.com. Cancellation takes effect at the end of your current billing period. You will retain full access to the service until that date. No further charges will be made after cancellation is confirmed. We do not prorate or refund partial months unless the circumstances meet the criteria set out in our Refund Policy.

5. Refund Policy

Our full refund terms, including the circumstances under which refunds are granted and the process for requesting one, are set out in our standalone Refund Policy at smartcodefixer.com/refunds. That document forms part of this agreement. In summary: subscription fees are non-refundable once a billing period has commenced, except in the specific circumstances described in the Refund Policy.

6. Acceptable Use

You may use SmartCodeFixer only for lawful purposes and in accordance with these Terms. You must not:

  • Reverse engineer, decompile, or attempt to extract the source code of the service
  • Resell, sublicense, or provide access to the service to third parties without our written consent
  • Use the API in a manner that exceeds your plan limits or circumvents rate controls
  • Submit code or content that is unlawful, malicious, or infringes the intellectual property rights of others
  • Use automated scripts or bots to interact with the service outside of the documented API
  • Attempt to gain unauthorised access to any part of the service or its underlying infrastructure
  • Use the service to develop a competing product or benchmark it for publication without our written consent

We reserve the right to suspend or terminate your account immediately if we determine, at our sole discretion, that you have violated this section.

7. Intellectual Property

SmartCodeFixer, including its software, algorithms, user interface, brand, and all associated content, is owned by DIGISMART MEGA LTD and protected by copyright, trade mark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the service for your own internal purposes during the subscription period. No other rights are granted.

You retain full ownership of all code and content you submit to SmartCodeFixer. By submitting code, you grant us a temporary, limited licence solely to process it for the purpose of delivering the service to you. We claim no ownership over your code.

8. Your Code and Data

We take the privacy of your code seriously. The following commitments apply to all code you submit to SmartCodeFixer:

  • No training use, your code is never used to train, fine-tune, or improve our AI models or those of any third party.
  • Transient processing, code is processed in memory to generate a response and is not stored beyond the active session unless you have explicitly enabled session history in your account settings.
  • Encryption, all data transmitted to and from our service is encrypted in transit using TLS. Data stored at rest is encrypted using AES-256.
  • No sale of data, we do not sell, share, or disclose your code to any third party except as required to deliver the service (e.g. our hosting provider, Vercel) or as required by applicable law.

9. Service Availability

We aim to keep SmartCodeFixer available and reliable, but we do not guarantee any specific level of uptime. The service is provided “as is” and we reserve the right to suspend access for scheduled maintenance, emergency repairs, or circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned downtime where practicable. We are not liable for losses arising from service unavailability unless otherwise required by applicable law.

10. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You must not share your login access with others or allow multiple individuals to use a single-user account. You are responsible for all activity that occurs under your account, whether or not you authorised it.

If you believe your account has been compromised, notify us immediately at info@smartcodefixer.com. We are not liable for any loss or damage arising from unauthorised use of your account where you have failed to take reasonable precautions to protect your credentials.

11. Limitation of Liability

To the fullest extent permitted by applicable law, DIGISMART MEGA LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising from or in connection with your use of SmartCodeFixer.

Our total aggregate liability to you for any claims arising under or in connection with these Terms, whether in contract, tort, or otherwise, shall not exceed the total fees you paid to us in the three calendar months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under English law.

12. Termination

You may terminate your account at any time by cancelling your subscription and ceasing use of the service.

We may suspend or terminate your account immediately and without prior notice if you: (a) breach any provision of these Terms; (b) fail to pay any subscription fee when due and do not remedy the failure within 7 days of notice; (c) use the service in a way that we reasonably believe exposes us or others to legal liability; or (d) engage in conduct that is abusive, fraudulent, or harmful to other users or to our systems. Upon termination for cause, you will not be entitled to a refund of any prepaid fees.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, those that significantly affect your rights or obligations, we will give you at least 30 days' notice by email before the changes take effect. For minor changes such as corrections or clarifications that do not affect your substantive rights, we will update the “Last Updated” date at the top of this page. Your continued use of SmartCodeFixer after the effective date of any change constitutes acceptance of the revised Terms. If you do not accept the changes, you must cancel your subscription before they take effect.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute or claim arising under or in connection with these Terms. If you are a consumer resident in another jurisdiction, you may also have rights under the laws of that jurisdiction that cannot be excluded by this clause.
